POCATELLO — A man who yelled at emergency medical technicians claiming to be a rapper, has been charged with a felony after spitting on an officer’s face.
Levi Miles Thomas, 44, faces a felony charge for battery on an officer, court records show.
Pocatello police officers responded to a request for assistance on the 300 block of East Center Street around 1:30 p.m. on Jan. 22, according to an affidavit of probable cause.
When they arrived, officers found a man they later identified as Thomas. Thomas told officers that he had drunk half a bottle of vodka and some beer, and he needed assistance.
Thomas removed several items from his pockets and threw them on the ground, the affidavit says. Then he asked to be handcuffed so he would not hurt anyone.
Officers placed Thomas in handcuffs and called for EMS. When EMS arrived, Thomas allegedly began yelling at responders, claiming to be a rapper named G-Eazy.
He was taken to Bannock County Jail for a protective hold, due to his level of intoxication.
As Thomas was being removed from the patrol vehicle, he spit on the face of one of the Bannock County Sheriff’s Office detention deputies, the affidavit says.
Rather than a protective hold, Thomas was booked for battery on an officer. He was later released on his own recognizance into the custody of his mother.
Though Thomas has been charged with this crime, it does not necessarily mean he committed it. Everyone is presumed innocent until they are proven guilty.
If he is found guilty, Thomas could face up to five years in prison.
He is scheduled to appear in court for a preliminary hearing before magistrate judge Aaron Thompson Wednesday.
