'Ashamed' Co Donegal man who attacked two strangers and left one bleeding in street begs for forgiveness

A Co Donegal man has expressed deep regret and sought forgiveness for inflicting two vicious assaults on total strangers, involving separate incidents. John McGinley, aged 20, grievously wounded one man in the ear and neck while he was waiting for a cab, as well as brutally attacking an elderly man during his morning stroll.

McGinley was present at Letterkenny Circuit Court to learn his fate after admitting guilt to the harrowing offences. Nevertheless, a probation report has labeled him as highly likely to reoffend.

He is also already serving time—three and a half years—for assaulting another individual with a knife outside a fast-food establishment in Letterkenny in April 2022.

The court understood that McGinley has been struggling with drug problems since he was just eleven and that he has also coped with psychiatric difficulties following the loss of family members.

Garda Sergeant Maurice Doyle recalled the newer charges against McGinley, who has six past convictions on record. In one incident, which occurred on October 31st, 2022, McGinley assailed a man unknown to him as he anticipated a taxi on Letterkenny’s Main Street, reports the Irish Mirror.

Patrick Durning, having spent time socialising after playing golf earlier in Portsalon, was looking to catch a ride home. Attempting to signal a taxi, he found himself flanked by two young men, suddenly feeling a sharp "pinch" in his ear followed by a wet sensation running down his neck—only to realise he was bleeding profusely.

A terrified victim, unsure if he had been stabbed with a bottle or a knife, ran across the road to alert Gardai about the incident. He was immediately rushed to Letterkenny University Hospital for emergency treatment of stab wounds on his ear and neck.

Upon arrival at the scene, Gardai identified McGinley as a suspect, who was found nearby on Port Road, holding a glass bottle. McGinley, heavily intoxicated, became extremely aggressive and abusive when approached by Gardai, leading to him being pepper-sprayed and restrained during his arrest.

A knife was discovered on McGinley during a search. However, during his interview, McGinley, from Glenwood Park in Letterkenny, denied any involvement in the assault but did identify himself in the CCTV footage shown by Gardai.

The victim, Patrick Durning, gave a distressing victim impact statement, revealing how the attack led to depression, social withdrawal, and a significant drop in confidence. He expressed his fear of being alone in public and constantly relives the traumatic incident, despite acknowledging his luck in surviving the ordeal.

McGinley's second savage attack was on a 70 year old pensioner who was out for an early morning walk at 5.45am in Glenwood Park, Letterkenny on June 16th, 2023. The court heard that James Doheny was out in his housing estate with his partner hoping to see the Red Moon.

As he strolled, a young man approached him, asked if he lived on the estate and claimed to know Mr Doheny. Suddenly, the young man threw a punch at Mr Doheny who managed to duck but was then hit with a punch in the kidneys causing him to fall.

Once on the ground, the young man kicked him in the head forcing Mr Doheny to cover his face, but not before another kick landed on his hand as he shielded his face. Mr Doheny's partner began screaming loudly and the attacker fled.

Gardai were called and a description of the attacker was given while CCTV from the area was also collected. Just after 6am, Gardai encountered McGinley at Ballymacool where he claimed he had been out walking to the shops.

His clothes were blood-stained and he claimed he had cut himself on a garden gate earlier. In his victim impact statement, Mr Doheny said he had called Glenwood his home for over three decades and raised five children there.

Before the brutal attack, he revealed he was recovering from a stroke and this incident had severely impacted his recovery.

The victim expressed his terror and helplessness during the attack, stating that it has severely impacted his mental health, leading to anxiety. He urged Judge Aylmer to consider the consequences on him when determining the sentence for McGinley.

Barrister for the accused, Mr Colm Smyth, SC, highlighted McGinley's early struggles with drugs and family losses which led to a dysfunctional life and self-harm. In a letter to Judge Aylmer, McGinley mentioned his 15-month prison term had given him time to reflect and he apologised to anyone he had hurt.

However, Mr Smyth noted his client's reluctance to undergo urine-analysis, psychiatric assessment or engage with probation services. Judge Aylmer stated this limited the potential for a suspended sentence.

After further discussions, McGinley agreed to engage with Probation Services and other treatments. Despite the severity of the offences, Judge Aylmer expressed a desire to assist McGinley due to his young age.

The final sentencing was adjourned until yesterday when McGinley reappeared in court.

Barrister Colm Smyth, SC, highlighted that despite a probation and welfare report indicating his client posed a serious risk of reoffending, the criminal activities were carried out under the influence of tablets and alcohol. He also referred to McGinley's personal struggles, including the death of an uncle, break up with an ex-girlfriend, and a considerable cocaine habit.

Smyth mentioned that now 20 year old McGinley sought a glimmer of hope for the future and reverted to substance misuse due to a lack of structure in his life. When he addressed the court, McGinley expressed deep remorse, stating he was "ashamed" and hoped for forgiveness from those he victimised, noting he had arranged to see a drug counsellor while imprisoned.

Judge John Aylmer declared he required further time to consider the 'totality principle' in sentencing and postponed concluding the sentence until the following week.
