Denying a child the right to education amounts to discrimination and therefore a violation of Article 12 of the Constitution which guarantees the right to equality for all, Attorney-at-Law Dr. Prathiba Mahanamahewa observed.

He said that the recent incident of a child in Kuliyapitiya being denied admittance to schools on the grounds that his/her parent or parents is/are allegedly human immunodeficiency virus positive and suffering from acquired immunodeficiency syndrome, was discriminatory and a violation of human rights.

He added that both the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights recognized the right to education. Sri Lanka has also ratified the International Convention on the Elimination of All Forms of Racial Discrimination.
